Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defect(s) as pointed out by the office when called upon to do so by the office. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366(A) and 34 of the Indian Penal Code.

It is a case of abduction of the victim lady by the petitioner, namely, Sumeet Kumar @ Sumit Kumar Yadav. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.1542 of 2021(4) dt.12-01-2022 2/3 that the petitioner has falsely been implicated in this case. He further submits that the petitioner has got clean antecedent. He further submits that the victim, namely, Anupam Kumari has solemnized marriage with this petitioner on 27.02.2020. From perusal of Annexure-3, Aadhar Card of the victim shows that her date of birth is 17.03.2001 and the date of occurrence is 25.02.2020 as such, it appears that the victim was major at the time of marriage.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

From perusal of para no.37 of the case diary, it appears that the victim Anupam Kumari has stated in her statement recorded under Section 164 of the Cr.P.C. that she solemnized marriage with the petitioner, namely, Sumeet Kumar @ Sumit Kumar Yadav in Munger Court and she is ready to live with him as wife and husband.

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
