10-12-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Yogapatti (Sanichari) P.S. Case No. 298 of 2021, registered for the offence under Section 307 & other allied sections of the Indian Penal Code. As per the F.I.R., the petitioner is alleged to have assaulted the son of informant on his head with iron rod. It is submitted on behalf of petitioner that as per injury report, the injury sustained by the son of informant has been found to be simple in nature by the doctor. Both parties are own gotiyas and due to land dispute between them, the alleged occurrence took place. There is case and counter case. Petitioner has got clean antecedent and he is in custody since 08.07.2021.

Patna High Court CR. MISC. No.56783 of 2021(2) dt.10-12-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Yogapatti (Sanichari) P.S. Case No. 298 of 2021.
