The petitioner has filed the instant application praying for modification of part of the order dated 10.3.2022 passed in Cr. Misc. no. 11415 of 2022.

It is submitted by learned senior counsel appearing for the petitioner that in connection with Chowk P.S. Case no. 434 of 2020 the petitioner was granted bail vide order dated 10.3.2022 passed in Cr. Misc. no. 11415 of 2022. While granting bail to the petitioner, certain conditions were imposed of which condition no. 3 was to the effect that 'the petitioner shall remain physically present in Court on each date of the trial and shall cooperate in the trial'. It is submitted by learned senior counsel that the petitioner who is 67 years old is

Patna High Court CR. MISC. No.44253 of 2022(2) dt.28-09-2022 2/2 suffering from various ailments including cardiac issues and is undergoing treatment at Mumbai. He requires to regularly visit hospitals outside the State of Bihar for treatment and as such the aforesaid condition be modified. The petitioner undertakes to cooperate in the trial and not to delay the same unnecessarily. Having heard learned counsel for the parties and taking into consideration the submissions made together with the contents of the petition, the order dated 10.3.2022 passed in Cr. Misc. no. 11415 of 2022 granting bail to the petitioner in connection with Chowk P.S. Case no. 434 of 2020 is modified to the extent that in place of the condition no. 3 as stated hereinabove, the same shall be replaced by the following: 'the petitioner shall be properly represented through his counsel on each day of the trial and shall cooperate in the trial. He will appear physically as and when directed by the learned trial court'.

Remaining part of the order dated 10.3.2022 (Annexure-1) passed in Cr. Misc. no. 11415 of 2022 shall remain unchanged. The application stands allowed to the above extent. The case stands disposed of.
