JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-07-2019 The petitioner has sought a direction to the respondent authorities to issue appointment letter to her for the post of Anganbari Sevika in the concerned centre at Ward No. 11 in the District of Nalanda.
2. It appears that pursuant to an advertisement No. 02/2018, the petitioner and others
2/4 including private respondent No. 9 applied for being appointed on such post. After counselling, private respondent No. 9 was selected and the name of the petitioner was placed second to the private respondent No. 9.
3. The petitioner thereafter lodged a complaint against the selection of private respondent No. 9 before the C.D.P.O, Islampur Block, Nalanda alleging that the educational certificates furnished by her were forged and fabricated. Necessary communication was thereafter made with the Secretary, Bihar State Madarsa Education Board, Patna regarding genuineness of the certificates furnished by the private respondent No. 9. While the process of enquiry was afoot, private respondent No. 9 submitted her resignation before the C.D.P.O., Islampur, Nalanda. Thereafter, all the efforts of the petitioner to get appointed on the post of Anganbari Sevika in place of private respondent No. 9 have gone in vain and
3/4 have not yielded any result.
4. There is no statement in the writ petition with respect to any fresh process of appointment having been initiated.
5. In any view of the matter, without there being any assistance from the learned advocate for the State, this Court only directs the petitioner to make a fresh representation before the District Programme Officer, Nalanda (respondent No. 6) intimating to him about the developments which have taken place after the resignation of private respondent No. 9, within a period of two weeks from today, who, on receipt of such representation shall have all the facts verified and pass necessary orders in accordance with law within a further period of four weeks thereafter.
6. In case the petitioner is not satisfied with the order of the District Programme Officer, Nalanda, she would have liberty to appeal against the aforesaid order of District Programme Officer, Nalanda before
4/4 the District Magistrate, Nalanda.
7. With the aforesaid observation/direction, the writ petition stands disposed of.
