The petitioner seeks bail in connection with Chakai P.S. Case No. 114 of 2020 instituted for the offences under Sections 147,148, 149, 341, 323, 307, 302, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 04.07.2021, is a person with clean antecedent, charge-sheet has been submitted in the case and is a woman.

Learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R. it would manifest that on account of dispute relating to fixing of hand pump, a quarrel took place between the side of the petitioner

No.57972 of 2021(2) dt.03-03-2022 2/3 and the informant and it is alleged at Kamdev Verma gave iron rod blow on the head of Vikash Verma @ Kishore Kumar Verma, Santosh Verma and Pappu Verma and also caused injuries to them by stick in which Vikash Verma @ Kishore Kumar Verma sustained grievous injury and other persons also sustained injuries.

Learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R. it would manifest that the petitioner has been implicated in this case merely because she is the wife of Kamdev Verma and it is alleged that she was trying to fix the hand pump over the ancestral land of the informant Meghan Mahto. It is also submitted that no overt act has been alleged against the petitioner.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 04.07.2021, is a person with clean antecedent, chargesheet has been submitted in the case, is a woman and no overt act has been alleged against her, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount
