JUSTICE AMARESH KUMAR LAL ORAL ORDER 20-03-2015 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in a case registered for the offence punishable under Sections 386, 387/34 of the Indian Penal Code. The allegation is that Rs.1 lac was demanded from the informant by the accused including the petitioners. When the informant went to a place to hand over Rs.30,000/-, the police came there and the accused including the petitioners tried to escape, but the petitioners were apprehended by the police.

It is submitted that a relative of the petitioners was admitted in the clinic of the informant and his condition was serious, he was referred to A.M.M.C.H, Gaya where some altercation took place between the informant and the petitioners and they have been falsely implicated in this case. The petitioners are in custody since 4.08.2014

Patna High Court Cr.Misc. No.44689 of 2014 (4) dt.20-03-2015 2/2 having no criminal antecedents. However, after investigation, the charge sheet has already been submitted and there is no chance of tempering with the evidence.

Considering the facts and circumstances of the case, let the above-named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Gaya in Magadh Medical P.S. Case No.106 of 2014 with the following conditions :

1.

One of the bailors will be the close relative of the petitioners.

2.

The petitioners will not indulge in similar or in any other offence.

3.

The petitioners will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the court concerned.
