The petitioner apprehends his arrest in Balmiki Nagar P.S. Case No. 10/2016, registered for the offences punishable under Sections 135, 126 of the Electricity Act. Allegation against the petitioner is of theft of the electricity, for which assessment has been made of loss of Rs. 7,48,982/- caused to the Electricity Department. Learned counsel for the petitioner submits that the petitioner is ready to deposit 20% of the assessed amount. Considering the facts aforesaid that the petitioner undertakes to deposit 20% of the assessed amount in three equal
Patna High Court Cr.Misc. No.45914 of 2017 (2) dt.10-10-2017 2/2 installments, first installment will be deposited by the petitioner within 15 days from today and the rest of the amount in two installments will be deposited in the gap of the same period, let the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Tirhut Area, North Bihar Power Distribution Company Limited, Muzaffarpur in connection with Balmiki Nagar P.S. Case No. 10/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
If the petitioner fails to deposit any of the installments of the aforesaid amount, the bail bond of the petitioner shall be cancelled.
