Mr.Amit Kumar Rakesh,APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 04-01-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Banka Mahila P.S. Case No. 40 of 2018 for the offence registered under Sections 376, 493 and 34 of the Indian Penal Code.

As per the prosecution story, the informant who was student of Intermediate and used to take tuition from the petitioner, during the said period, he committed rape on her and also made her pregnant which was later aborted. Further, upon proposal for marriage, he backed out.

The matter is of 2018 and the petitioner has finally approached this Court only in 2022.

Taking into account the inordinate delay as also the specific allegation against him of exploiting the young girl, this
