The petitioner apprehends his arrest in connection with Rasulpur P.S. Case No. 103 of 2016, registered under Sections 341, 323, 354, 379 and 504/34 the Indian Penal Code. The accusation is that informant was collecting soil behind her house in the meantime, petitioner reached and caught hold her anyhow she got herself free and she narrated the incidence to her husband Uday Shankar, who also made protest. Thereafter, petitioner along with his other family members named in the F.I.R. came with lathi and caused injury to her husband.
Learned counsel for the petitioner submits that, in fact, petitioner and the informant are next door neighbour and due to grudge and enmity scuffle took place in which petitioner side also sustained
Patna High Court Cr.Misc. No.15861 of 2017 (3) dt.13-07-2017 2/2 injuries regarding which Rusulpur P.S. Case No. 100 of 2016, under Sections 341, 323, 324, 307, 379 and 504/34 was instituted by petitioner. Further submission is that the injury found on the person of the husband of the informant is simple in nature. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-10th Saran at Chapra in connection with Rasulpur P.S. Case No. 103 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
