Anticipatory bail petition of the petitioner was earlier rejected by this court.

During course of argument in this court, the counsel for the petitioner has submitted that there is no specific allegation against this petitioner of assaulting the informant. There was only allegation that he has thrown farsa. In the FIR, there is specific allegation against this petitioner that he assaulted the informant with farsa on account of which, he sustained injuries and became unconscious.

In such circumstances, it appears that wrong submission has been made in this court.

There is specific allegation against the petitioner in the

Patna High Court Cr.Misc. No.34157 of 2017 (4) dt.13-09-2017 written report. Therefore, this court does not find any fresh ground to reconsider prayer of the petitioner for anticipatory bail. Accordingly, prayer for anticipatory bail of the petitioner is rejected.

The petitioner is directed to surrender in the court below within four weeks from today and seek regular bail which will be considered by court below on its own merit without being prejudiced by this order.
