At the outset, learned counsel appearing for the Housing Board has pointed out that the present writ application is completely defective and invalid for the reason that the petitioner has not sworn affidavit in the present writ application and in fact it has been sworn by one Mr. Jai Prakash who claims to be the Advocate's Clerk of Mr. Mukul Sinha. This is strange for the reason that the Patna High Court Rules does not permit

Patna High Court CWJC No.3209 of 2015(4) dt.23-04-2025 2/2 swearing of affidavit by Advocate's Clerk in the writ application.

3. Learned counsel for the petitioner prays for withdrawing the present writ application with liberty to file a fresh application.

4. Liberty is granted and the present writ application is dismissed as withdrawn.
