JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 21-01-2019 Petitioner is seeking anticipatory bail in connection with Mufassil P.S. Case No.112 of 2017 registered for the offences punishable under Sections 341, 323, 324, 325, 307, 379 and 34 of the Indian Penal Code.

Learned counsel representing the petitioner submits that the allegation against this petitioner is that he had assaulted the informant by 'Garasa' on the head of the informant but on perusal of the injury report it would appear that a lacerated wound has been found on the head of the informant which is simple in nature and caused by heard blunt substance. Learned counsel submits that no 'Garasa' injury has been found on the head of the informant.

Learned APP for the State is not present.

In the given facts and circumstances, taking note of

Patna High Court Cr.Misc. No.57148 of 2018(4) dt.21-01-2019 2/2 the nature of the injury given in the injury report, let the petitioner abovenamed be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Mufassil P.S. Case No.112 of 2017 subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation, failing which the Investigating Officer shall be at liberty to take steps for cancellation of his bail bond. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C. (Rajeev Ranjan Prasad, J) R.R.Ojha/- U T
