The petitioners apprehend their arrest in Biraul P.S. Case No. 177 of 2020, registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

Prosecution case in brief is that due to land dispute in respect to Rasta on the alleged date and time of occurrence while the informant's grand-mother came out of house, all the accused persons including petitioners having variously armed came there and started abusing. When the informant and his mother objected, this petitioner assaulted the informant with tengari causing head injury. On alarm neighbours came and saved the informant.

The present case is counter blast of Biraul PS Case No. 189 of 2020 which is lodged by petitioner's side against informant and others. Injuries found on the person of injured are simple in nature. Petitioners have got clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Biraul, Darbhanga in connection with Biraul P.S. Case No. 177 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
