2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Gaurichak P.S. Case no. 152 of 2025 instituted for the offence punishable under Sections 126(2), 115(2), 352, 351(2), 351(3), 109 and 3 (5) of the BNSS Act AND Section 27 of the Arms Act.

3. As per allegation in the FIR, informant was living at his sasural and possessing four bighas of land as he has no

On the alleged date of occurrence, while he was returning from Hospital after getting treatment of his son, accused persons abused him. Allegedly, for the said land, petitioner no. 1 threatened him to kill. It is further alleged that accused Ranjan Kumar with intention to kill him, opened fire upon him which hit near his left knee.

4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. As per FIR, specific allegation of opening fire is attributed to accused Ranjan Kumar and not against these petitioners. Admittedly, there is land dispute between the parties and in Probate Case No. 01 of 2017 and Title Suit No. 14 of 2019 injunction order against the informant has been passed. There is case and counter case and in the alleged scuffle, members of both sides have received injuries. General and omnibus allegation has been levelled against the petitioner.

5. Learned APP appearing for the State has opposed the prayer of Bail.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The

No.45139 of 2025(3) dt.01-08-2025 3/3 petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Gaurichak P.S. Case no. 152 of 2025, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Patna City subject to the conditions as laid down under section 482 of the BNSS.
