The petitioner apprehends her arrest in Araria P.S. case No. 367 of 2017 for the offences punishable under Section 467, 468, 406, 420, 120B of the Indian Penal Code. The District Agriculture Officer alleged that petitioner issued cash memo of Rs. 61,82,000/- to different farmers for selling agricultural apparatus and on that basis subsidy of Rs. 9,76,500/- was transferred in the account of different farmers. The farmers in whose account subsidy was transferred also returned Rs. 4,72,000/- as no purchase was made by them. The informant alleged that petitioner in collusion with farmers issued fake cash memo.
Patna High Court Cr.Misc. No.34941 of 2017 (3) dt.23-08-2017 2/2 The learned counsel for the petitioner submits that petitioner issued cash memo only after selling the agricultural apparatus. There is nothing on record to show that petitioner did not sale any apparatus to the farmers. No farmer made any complaint against the petitioner.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S. case No.367 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
