The petitioner apprehends his arrest in a case under sections 406,420,120B/34 of the IPC.
It is alleged that the petitioner, who was posted as ASI of police in Banjaria P.S. in the year 2011-12, duped the informant for a sum of Rs.2,00,000/- for securing two appointments of his cousin showing his proximity with an Addl. Director General of Police. It is further alleged that at the time of receiving the amount, the petitioner was accompanied with one Nawal Kishore Thakur.
The petitioner denies the allegations and submits that he has clean service record and there is no chit of material to connect him and his associate in the alleged crime.

No.12957 of 2017 (4) dt.13-07-2017 2/2 On the other hand learned counsel for the informant and the State submit that the recorded conversation of the petitioner produced before the police, establish his involvement in the alleged offence. The details of the Bank account of the petitioner would show his complicity in the alleged crime. Having regard to the facts and circumstances of the case, the petitioner Vijay Paswan @ A.S.I. Vijay Paswan is directed to be released on anticipatory bail, in the event of his arrest/surrender, on furnishing bail bonds of Rs. 5,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari in connection with Ramgarhwa P.S. Case No.54 of 2016 subject to the condition that he would deposit a sum of Rs.
70,000/- in the court below, within a period of six weeks from today, which would be subject to outcome of the case. In case the petitioner fails to deposit the aforesaid amount within the stipulated time, the anticipatory bail granted to him stands recalled. (Samarendra Pratap Singh, J) Shashi.
