Petitioner apprehends arrest in connection with Minapur P.S. Case No. 75 of 2020 registered for the offence punishable under sections 272 and 273 of the Indian Penal Code and sections 30(a), 41(1) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery is said to have been made from the bushes of straw and bamboo behind his house which is an open space and is accessible to
Patna High Court CR. MISC. No.4696 of 2021(3) dt.22-10-2021 2/2 all as is evident from the seizure list. Petitioner is a man of clean antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing of his personal bond to the satisfaction of Special Judge, Excise Act, Muzaffarpur in connection with Minapur P.S.
