JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-07-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). For issuance of a writ of mandamus or any other appropriate writ order or direction commanding the respondent authorities to remove the encroachment from the land of Muslim Graveyard Village Sajour, P.S. Sajour, District- Bhagalpur bearing Khata No. 1422, Khesra No. 1961, Mauza Sajour, Anchal Shahkund as some of the anti social element has been forcibly existed huts upon the land in question.
Patna High Court CWJC No.5185 of 2015(3) dt.31-07-2024 2/2 (ii). For issuance of a writ of mandamus or any other appropriate writ order or direction commanding the respondents authorities to not to interfere in the peaceful possession & occupation of the Muslims grave yard in respect to the village and P.S. Sajour, District- Bhagalpur. (iii). For issuance of an appropriate writ order or direction commanding the respondents to protect the Muslim Graveyard in question by erecting a boundary walls around the same."

At the outset, the learned counsel for the petitioner seeks a direction upon the Respondent No. 4 i.e. the District Magistrate, Bhagalpur, to get the land belonging to Muslim Graveyard demarcated, which is situated at village-Sajour, P.S.- Sajour, District-Bhagalpur, appertaining to Khata No. 1422, Khesra No. 1961, within a stipulated time frame, preferably within a period of eight weeks from today. It is directed accordingly.
