Heard learned counsel for the petitioner as well as the learned APP for the State assisted by learned counsel for the informant.

The petitioner apprehends his arrest in connection with Complaint Case No. 525(C)/2019, registered for the offences punishable under Sections 193, 420, 468 and 471 of the Indian Penal Code.

Complainant Rahul Kumar @ Rahul Raj Sharma has filed a complaint against the petitioner, alleging therein that in

Patna High Court CR. MISC. No.5315 of 2021(3) dt.14-12-2021 2/3 Title Suit No. 35 of 1924, in which the grandfather of the complainant was one of the parties and that suit was decreed and the accused persons after interpolation in that photostat copy of the certified copy of that decree in place of name of his grandfather, they entered the name of their ancestors. Learned counsel for the petitioner has submitted that on the basis of that decree, the name of the petitioner was entered in revenue records. He has submitted that complainant has contested the case before the revenue authorities, but he did not become successful. He has also submitted that already the petitioner has filed a petition under Section 340 of the Code of Criminal Procedure, which was also rejected.

Considering the above-mentioned facts and circumstances as well as the fact that the matter is of civil nature, let the petitioner be released on bail in the event of their arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Masaurhi in connection with Complaint Case No. 525 (C) of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the
