JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 09-10-2018 This writ petition was filed by the petitioner in the capacity of Mukhiya of Nadiauna Gram Panchayat for quashing memo no.811 dated 24.04.2015 issued by the respondent no.5 by which construction work of Anganbari Centre and Community House in Gram Panchayat, Nadiauna has been stayed. He has also prayed for quashing memo no.41 dated 06.01.2016 issued by the respondent no.5 by which the respondent no.7 has been directed to stop construction work of Community building in village Mahadev Bigha under Nadiauna Gram Panchayat.

Patna High Court CWJC No.6337 of 2016(6) dt.09-10-2018 2/2 At the outset, it has been brought to my notice that the petitioner is no more Mukhiya of the Nadiauna Gram Panchayat as in the subsequent election held in the year 2016 someone else has been elected Mukhiya of the said Gram Panchayat. In that view of the matter, the writ petition is disposed of as infructuous.

In case cause of action still survives, the new incumbent may approach the authorities first or take any other legal steps for redressal of his grievances.
