The petitioner is apprehending his arrest in connection with Akorhigola P.S. Case No. 29 of 2017 registered for the offences punishable under Sections 341, 342, 323 and 307/34 of the Indian Penal Code.
Allegation against the petitioner is that he assaulted the informant, due to which he became unconscious and he was hospitalized and after four days when he was discharged he has named this petitioner.
It has been submitted on behalf of the petitioner that the allegation is false and concocted and there is delay in lodging FIR of six days. Further submission is that the injury report has been submitted by a private doctor.
Heard learned APP also, who has opposed the prayer
Patna High Court Cr.Misc. No.36749 of 2017 (2) dt.18-08-2017 2/2 for anticipatory bail.
Having heard both sides and in the facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner.
Let petitioner surrender before the court below and pray for regular bail, which shall be considered on the basis of the allegation as well as the injury report.
With the above observation, this application is dismissed.
