The petitioner seeks bail in Nagar P.S. Case No. 16 of 2021, registered for the offence punishable under Section 379 of the Indian Penal Code.

One stolen motorcycle has been recovered from the house of this petitioner.

It is submitted on behalf of the petitioner that no incriminating article has been recovered from possession of this petitioner. No test identification parade has been held till date. Petitioner happens to be mechanic and the said motorcycle was brought to his Garage by the co-accused Nirbhay Kumar for repairing. Petitioner has been remanded in this case from Falka P.S. Case No. 30 of 2021 on 03.02.2021 and on his own confession before the police his name transpired in this case.

Patna High Court CR. MISC. No.56495 of 2021(2) dt.07-12-2021 2/2 Petitioner is in custody since 23.03.2021.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Katihar in connection with Nagar P.S. Case No. 16 of 2021.
