09-05-2018 Heard the learned counsel for the petitioner and counsel appearing on behalf of the State.
Learned counsel for the petitioner submitted that the petitioner has been paid admissible post retired dues except leave encashment. He submits that the issue is to entitlement of leave encashment is no more res integra. The issue was answered by a Coordinate Bench in C.W.J.C. No.23 of 2015 vide order dated 03.08.2015 which was affirmed by the LPA Court in L.P.A. No.1856 of 2016 vide order dated 16.03.2017.
In view of the above, the respondents are directed to ensure payment of leave encashment to the petitioner within a maximum
Patna High Court CWJC No.3562 of 2016 (6) dt.09-05-2018 2/2 period of 60 days from the date of receipt of a production of a copy of this order.
