====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 20-12-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Huge quantity of liquor was allegedly recovered from the four wheeler of this petitioner. The driver of the vehicle fled away. The petitioner as well as the driver are accused in this case.

Submission is that the petitioner had knowledge what the driver was carrying on the vehicle. The petitioner cannot avoid his criminal responsibility in respect of his vehicle which was carrying banned item.

Hence, I am not inclined to enlarge the petitioner on

Patna High Court Cr.Misc. No.59635 of 2018(3) dt.20-12-2018 2/2 anticipatory bail in connection with Chainpur Police Station Case No. 118 of 2018 pending in the court of learned 6th Additional Sessions Judge-cum-Special Judge (Excise), Kaimur at Bhabua.

Accordingly, prayer for anticipatory bail is refused. Petitioner may surrender and pray for regular bail. (Birendra Kumar, J) Kundan/Banti U T
