The petitioner namely Rama Shankar Singh is in custody since 16.11.2013 in Sessions Case No.693(A) of 1986 arising out of Barahiya P.S. Case No.67 of 1986 u/s 363 and 364 of I.P.C.

It appears that the petitioner was earlier granted regular bail by the High Court. Subsequently, he misused the privilege of bail, therefore, his bail bond was cancelled in the year 2004 and thereafter the petitioner has been arrested on 16.11.2013 and since then he is in custody.

The learned counsel for the petitioner submitted that

Patna High Court Cr.Misc. No.45630 of 2014 (2) dt.04-02-2015 the petitioner is a labour and had gone outside the State in connection with his livelihood. The petitioner undertakes that the petitioner will attend the court on each and every date till the sessions case is concluded.

Considering the aforesaid submission of the learned counsel, I direct that the above named petitioner be released on bail on furnishing bail bond of Rs.10,000(ten thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Adhoc A.D.J.-Vth, Lakhisarai in connection with Sessions Case No.693(A) of 1986 arising out of Barahiya P.S. Case No.67 of 1986 on condition that if he will misuse further for two consecutive dates, his bail bond shall be cancelled. One of the bailors should be close relative of the petitioner.
