JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 13-07-2017 Petitioners, who are father-in-law and mother-in-law of the deceased, apprehend their arrest in a case under sections 304B, 201/34 of the IPC.
Learned counsel for the petitioners submits that the husband of the deceased has been granted regular bail under section 167(2) of the Cr.P.C. Petitioners further submit that they stay separate and have no concern with the affairs of the deceased and her husband. A compromise petition has also been filed in the court below.
Counsel for the informant submits that the victim was killed within two years of marriage.
In the event of arrest/surrender, let petitioner no.2 as mentioned above be released on bail on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.17484 of 2017 (5) dt.13-07-2017 2/2 satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Desari Chandpura OP) Police Station case no. 230 of 2016. Prayer for bail to petitioner no.1 mentioned above is refused with direction to surrender and seek regular bail which would be disposed of on its own merit without prejudice also taking into consideration Annexure 2. He is also at liberty to produce all the relevant documents in the court below at the time of disposal of his bail petition.
