Petitioner seeks regular bail in connection with Special Excise Case No. 396 of 2021 arising out of Purnea Sadar PS Case No.- 261 of 2021 registered under Section 272 / 273 of the IPC and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Police intercepted a blue colour Magic Pick-Up Van and recovered 442.875 liters of illicit foreign liquor from the same and arrested the petitioner.

Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and he has falsely been implicated by the police with oblique motive. Learned counsel next submits that petitioner is a farmer and in no way related to the blue colour Magic Pick- Up Van as

Petitioner has got no criminal antecedent, he is in custody since 30.05.2021 and charge sheet has already been submitted. Learned counsel next submits that similarly situated co-accused Md. Aalam has been granted bail by this court vide Cr. Misc. No. 52742 of 2021.

Regard being had to the submissions made by the parties and taking into consideration the material available on record, the fact that petitioner has got no criminal antecedent, he is in custody since 30/05/2021, charge sheet has already been submitted and similarly situated co-accused has been granted bail by this court, as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Purnea in connection with Special Excise Case No.- 396 of 2021 arising out of Purnea Sadar PS No.- 261 of 2021.
