In this case, the petitioner is apprehending his arrest in connection with Hasanpur P.S. Case No. 32 of 2019 registered for offences under sections 379/411/461/34 of the Indian Penal Code.
As per prosecution case, some thieves, by breaking the lock, entered into the shop of the Informant and his brother with an intent to commit burglary, they were chased, two persons succeeded in fleeing away from there but, one person was arrested and who disclosed the name of the present

Learned counsel for the petitioner submits that at the time of occurrence, the petitioner was busy with the treatment of his wife in the hospital and Deepak Kumar Yadav, who was arrested, has taken his name on account of previous enmity.
Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
Accordingly, the prayer for bail of the petitioner, above named, is rejected.
If the petitioner surrenders before the court below within a period of three weeks from today and makes a prayer for bail, the court below, without being prejudiced by this order, will pass orders in accordance with law preferably on the same day of his appearance.
