====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 05-04-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Sangrampur P.S. Case No. 72 of 2020 registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

The prosecution story is that on 13.04.2020, the petitioner along with other four persons came at house of informant and called his son but his son did not return till night however on 14.04.2020, the informant got information that his son was hanged on tree. It is alleged that at occasion of last Dipawali, the accused had threatened his son.

He further submits that there is no specific overt act against the petitioner. He further submits that the deceased Chanan Kumar was accused in Sangrampur P.S. Case No.211 of 2017 under Sections 363, 366, 504/34 I.P.C., he was fled with daughter-inlaw of Chandradeo Mahto and police has submitted charge sheet on 06.11.2018. He further submits that the deceased was working under the petitioner in Banglore they came back in period of corona and the petitioner refused to join deceased due to his character in Banglore moreover there is no eye witness of the occurrence and relative of informant has stated that she saw deceased on bike along with one Ranjan Sah and other witnesses have stated as to unfair character of deceased. Petitioner is in jail custody since 18.04.2020 and petitioner has got no any criminal antecedent mentioned in paragraph-3 of the bail petition.

Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned
