JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-02-2018 Heard the learned counsel for the petitioner and the learned counsel for the State.

The petitioner seeks anticipatory bail in connection with Rampur PS case no. 27 of 2016 registered for the offences punishable under Section 409 of the Indian Penal Code. The allegation against the petitioner is regarding nonsubmission of measurement book and consequently, the petitioner was dismissed from service on 2.7.2017, whereafter the present case was lodged against him.

The learned counsel for the petitioner submits that the aforesaid dismissal was set aside by this court by an order dated 16.10.2015 passed in CWJC No. 14270 of 2015. It is further submitted that the only allegation against the petitioner is

Patna High Court Cr.Misc. No.17227 of 2017 (10) dt.05-02-2018 2/2 regarding non-submission of measurement book and there is no other allegation of any kind of embezzlement or defalcation of money. It is submitted that the petitioner has a clean antecedent. Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of this order, the petitioner above named is directed to be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 4th, Gaya in connection with Rampur PS case no. 27 of 2016, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
