The petitioner seeks regular bail in a case under section 364/511/34 of the Indian Penal Code and section 3(1)(X) of S.C./S.T. (Prevention of Atrocities) Act.

The son of the victim made an allegation that the petitioner and other accused persons kidnapped his father. It is submitted that after 20 days of the occurrence, the F.I.R. was lodged. The victim returned and made a statement but did not disclose the name of the petitioner. Charge-sheet was submitted in the year 1996 showing the petitioner absconder. The petitioner is in jail since 11.03.2014. Other accused persons have already been enlarged on bail.

Considering the facts and circumstances of the

Patna High Court Cr.Misc. No.45632 of 2014 (2) dt.04-03-2015 case and that the petitioner has already remained in jail for about one year, he is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Bhagalpur in connection with Sessions Trial No. 582 of 2014/T.R. No. 41 of 2014.
