The petitioner apprehends his arrest in connection with Sultanganj P.S. Case No. 214 of 2016, registered under Sections 419, 420 of the Indian Penal Code and Section 3/4 of Bihar School Examination Conduct Rules, pending in the court of the A.C.J.M. 1st Bhagalpur.
The accusation is that in the examination of B.A. Part-I (Rastrabhasa) one Nitesh Kumar and Ranjan Kumar were found sitting in the examination hall in place of one Prince Kumar and this petitioner.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly,
Patna High Court Cr.Misc. No.17790 of 2017 (2) dt.13-07-2017 2/2 his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trail Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
