====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-11-2021 Heard learned counsel for the petitioner and learned APP for the State.

Learned counsel for the petitioner is expected to honur his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307, 323, 341/34 of the Indian Penal code.

Learned counsel for the petitioner has submitted that the petitioner and informant, Kundan Singh, are cousin brothers and there is case and counter case regarding partition of the properties. He has further submitted that the amicable settlement between the parties has taken place. The Xerox copy of the compromise petition has been annexed as Annexure-3, which

Patna High Court CR. MISC. No.3261 of 2021(2) dt.03-11-2021 2/2 shows that both the case and counter has been compromised. Learned APP appearing on behalf of the State has vehemently opposed the prayer for bail.

Consider the fact that both the parties have compromised the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Barahiya P.S. Case No.14 of 2020 (G.R. No.69 of 2020), subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. Office shall ensure that all defects are removed and compliance with the notices of this Court are made by the petitioner within the stipulated time provided in para 2 hereinabove, failing which the matter shall be brought to the notice of this Court.
