JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 08-08-2019 After hearing learned counsel for the petitioner and learned counsel for the Bank what has ultimately transpired that there is a dispute between the parties now over the amount of interest for about 2 years period and then two additional loan accounts. Going through the counter affidavit particularly the statement made in Paragraph 29 when this Court found that the Bank has offered the petitioner to come and sit together to discuss the calculation issues and settle the account, this Court called upon Mr. Jha, learned counsel representing the petitioner to take a stand as to whether or not he is looking for resolution of the dispute by sitting together with the authorities of the

Mr. Jha submits that his client is also looking for such settlement but because the Bank had not cooperated the issues have not been settled so far.

Learned counsel for the petitioner submits that on such amicable settlement of the dispute the petitioner would pay the admitted amount whatsoever comes against him. At the outset, learned counsel for the RespondentBank submits that during pendency of the writ application the Bihar Gramin Bank has been reorganized and now the name of the Bank in the array of the respondents be allowed to be substituted by name Dakshin Bihar Gramin Bank with the present address of Head Office.

Learned counsel for the petitioner is permitted to do so in course of the day so that the order passed today may be issued containing correct name and address of the respondents. In the given facts and circumstances of the case, the writ application is being disposed off with a direction to the General Manager, Dakshin Bihar Gramin Bank, Head Office Patna (Respondent No. 3) to communicate the petitioner within two weeks from today a date and time of the meeting with him and on receipt of such communication the petitioner shall visit

Patna High Court CWJC No.11598 of 2016(3) dt.08-08-2019 3/3 the office of respondent no. 3 on the said date and time where both the parties shall discuss the issues relating to settlement of accounts and shall take efforts to amicably resolve the dispute.
