In the light of the statement made in the supplementary affidavit, counsel for the petitioner is permitted to make necessary correction in paragraph 3 of the main petition in course of the day.

Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 401, 413, 414, 411/34 of the Indian Penal Code. Allegation is that the accused persons including the petitioner committed theft of gold and silver ornaments and house hold articles from residential house of P.T.S.C. 243. It has been submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.44058 of 2019(2) dt.18-07-2019 2/2 the petitioner is in custody since 1.5.2019. There is no allegation of tampering of witnesses alleged against the petitioner. The name of the petitioner has transpired in the present case on the confessional statement of co-accused. There is no recovery of any incriminating article from the possession of the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalagaun N.T.P.C. P.S. case No.35 of 2018.
