The present writ application has been filed for a direction to the respondent authorities to get the encroachment removed from the public land appertaining to Khata No. 69, Plot No. 459 and Plot No. 478, situated in Obara Block of Aurangabad District.
Learned counsel for the petitioner seeks permission to withdraw the present writ application in view of the statement made in paragraph no. 21 of the counter affidavit filed on behalf of respondent nos. 3 and 4 that the encroachment has been removed from the land in question. Paragraph no.21 of the counter affidavit
Patna High Court CWJC No.21343 of 2013 (2) dt.21-06-2017 2/2 reads as follows:- "That from the facts as stated herein above, it is obvious that the encroachment from the public land bearing Khata No. 69, Plot No. 459 and 478 of Mauza-Karamchari, Tole-Leela Bigha under gram Panchayat-Kanchanpur, Police StationObra, District-Aurangabad has already been removed by dismantling the illegal construction over it and now it is free from encroachment."
Permission is accorded.
Accordingly, the present writ application is disposed of as withdrawn.
