JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 21-01-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel representing O. P. No. 2. The petitioner is the husband of O. P. No. 2 and is seeking anticipatory bail in connection with Habibpur P. S. Case No. 63 of 2018 registered for the offences punishable under Sections 498 (A) of the Indian Penal Code and Sections 3⁄4 of Dowry Prohibition Act.
At the outset, learned counsel for both the parties submit that they are willing to live together and establish their matrimonial home but learned counsel representing O. P. No. 2 on instruction has expressed apprehension as to conduct of the parents of O. P. No. 2.
It is submitted that the petitioner is living with some

Objecting to the said submission of learned counsel for opposite party no. 2, learned counsel representing the petitioner submits that the statement is not correct. The petitioner is not living with any other woman and is ready to keep O. P. No. 2 with full dignity and care. It is submitted that the petitioner will visit the Maike of O. P. No. 2 within two weeks from today and shall bring her back to the matrimonial home.
Taking note of the aforementioned submissions and after recording the undertaking of the petitioner that he would visit the Maike of the informant/opposite party no. 2 within a period of two weeks from today, this Court directs that the petitioner above named, in case of his arrest or surrender within four weeks from today, be released on bail on execution of bail bonds of Rs. 15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XII, Bhagalpur in connection with Habibpur P. S. Case No. 63 of 2018, subject to the condition that he will go to the Maike of O. P. No. 2 within a period of two weeks with prior information to the Station House Officer of the concerned Police Station within whose jurisdiction the O. P. No. 2 resides. He will bring back to O. P. No. 2 to his matrimonial home and shall keep her

It is made clear that in case of any complaint of O. P. No. 2 and on filing of an application for cancellation of bail on such ground the same will be considered by this Court in accordance with law.
