04.03.2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in Sasaram (Darigaon) P.S. Case No. 716 of 2014 dated 07.08.2014 instituted under Sections 376/511/379 of the Indian Penal Code.
Learned counsel for the petitioner submits that though as per the allegation, he had tried to commit rape but the allegation is false and the further allegation of snatching of ear rings is only ornamental so that grievous Sections of the Indian Penal Code may be applied. Learned counsel submits that though he has antecedent of four other cases but all are from his agnate, Chandrika Singh and even in the present case, the informant is the wife of Guddu Sah
Patna High Court Cr.Misc. No.47039 of 2014 (2) dt.04-03-2015 2/2 and servant of Chandrika Singh and thus the petitioner is the victim of false implication at the behest of Chandrika Singh one after the other and accordingly there has also been counter case from the side of the petitioner. Learned counsel submits that the petitioner is aged 63 years and is in custody since 14.08.2014.
Learned A.P.P. opposes the prayer for bail.
Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in Sasaram (Darigaon) P.S. Case No. 716 of 2014. The petitioner shall cooperate in the trial and be present before the Court on each and every date. Failure to cooperate or appear on two consecutive dates, without sufficient cause, shall lead to cancellation of his bail bonds.
