The petitioners are apprehending their arrest in connection with Bidupur P.S. Case No. 85 of 2017 lodged under Sections 147, 148, 149, 341, 323, 324, 307, 427, 447, 448 and 379 of the Indian Penal Code.
Allegation against the petitioners is of assaulting the informant and other injured persons.
Submission of learned counsel for the petitioners is that there is case and counter case between the parties and both sides have received injuries. Further submission is that occurrence took place with respect to a patty dispute and there was no intention on the part of the petitioners to cause injuries on the
Patna High Court Cr.Misc. No.37249 of 2017 (2) dt.19-08-2017 2/2 persons of the injured and the injuries are simple in nature. Heard learned APP also.
Having heard both sides and in view of facts and circumstances, let petitioners surrender before the court below within a period of four weeks and on their so surrendering they shall be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Bidupur P.S.Case No. 85 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and they will co-operate in investigation, failing which their bail bonds shall be liable to be cancelled.
