2. In this case, the petitioner is seeking regular bail in connection with Bikram P.S. Case No. 253 of 2023, registered for the offences punishable under Sections 8(c) and 21(b) of the NDPS Act.

3. As per allegation, 9.88 grams of smack was recovered from house of the petitioner.

4. Learned senior counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated. The alleged contraband was not recovered from conscious possession of the petitioner and the house wherefrom the alleged smack was recovered is a joint house of the petitioner. Further submission is that the quantity of seized contraband is slightly more than small quantity but lesser to commercial quantity. The petitioner is under custody since

Considering the above-mentioned facts and circumstances clean antecedents as well as the period of detention, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge (NDPS), Patna in connection with Biram P.S. Case No. 253 of 2023, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available on each and every date of trial. In case of failure on two consecutive dates, the learned court below will be at liberty to cancel the bail bond of the petitioner. (Nawneet Kumar Pandey, J) SONALI/- U T
