The petitioners apprehend their arrest in connection with Dehari R.P.F. P.S. Case No.06 of 2019 registered under Section 3RP(UP) Act.
The accusation is that in course of patrolling duty by the informant along with other R.P.F. personnel on the railway track, one pickup van was seen on which railway coal was being loaded. Thereafter, the informant and other R.P.F. personnel reached there and caught hold of one Manjesh Kumar Sharma, the driver of the pickup van, and seized the pickup van loaded with railway coal. The apprehended accused disclosed that he is indulged in loading the railway coal from before in association of the petitioners.

No.44143 of 2019(2) dt.18-07-2019 2/2 Learned counsel for the petitioners submits that the petitioners were not apprehended on the spot rather their name has been disclosed by the apprehended accused Manjesh Kumar Sharma. Further submission is that the petitioners are accused in one case of similar nature, as detailed in paragraph-3 to this application, in which they are on bail, due to that reason, the informant got managed to implicate the petitioners in the present case. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Railway, Gaya, in connection with Dehari RPF P.S. Case No.6 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
