JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Khagaul P.S. Case No. 186 of 2016, registered under Sections 406 and 420/34 of the Indian Penal Code.

The allegation of informant, Arti Devi, is that after the death of her husband she used to reside at her Maika situated near Medical Colony, Quarter No. 709, Khagaul. During that period, she came in touch with accused persons. While she had managed to cash for purchasing of land but the nine persons named in the F.I.R. including the petitioner took friendly loan as detailed in the F.I.R. on assurance to return the same within fifteen days but after

Learned counsel for the petitioner submits that, in fact, the informant was involved in the business of cheat fund and collected the money from several ladies including the petitioner and on demand she lodged the present case against the nine persons showing about giving money to all accused persons including the petitioner.

Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Danapur, in connection with Khagaul P.S. Case No. 186 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
