JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-04-2019 This is an application for grant of anticipatory bail in connection with Gopalganj Town P.S. Case No. 257 of 2018, disclosing offences under Sections 406, 420, 467, 468, 471, 120(B), 34 of the Indian Penal Code.

Allegation against the petitioners is that they have taken agricultural loan of Rs.3,50,000/- and Rs.3,00,000/- respectively against the ornaments, which were later on found to be fake.

Submission of learned counsel for the petitioners is that as a matter of fact the gold was verified by the valuer and thereafter the same was kept in a sealed cover and further on behalf of the petitioner no.1 Anil Kumar Ram is that he has also

No.60099 of 2018(3) dt.08-04-2019 2/2 been deposited some amount of loan amount of Rs.3,13,975/-, however he has not lodged a case against the bank authority in this connection. It has further been submitted that another accused person has been granted anticipatory bail by a Coordinate Bench of this Court.

Heard learned A.P.P. as well as learned counsel for the S.B.I., they have opposed the prayer for anticipatory bail of the petitioners stating that another accused person has been granted conditional bail on depositing the amount.

Having heard both sides, in view of the facts and circumstances of the case as stated above, this application is disposed of with a direction to the learned court below that if the petitioners are ready to deposit the amount of Rs.3,50,000/- and Rs.3,00,000/- respectively in the some reasonable installments, they will be released on provisional bail by the learned court below to his own satisfaction for a reasonable period, otherwise he is free to pass any other order or order as he deems fit and proper.
