2. The petitioner seeks regular bail in connection with Sessions Trial No.741 of 2023 arising out of Naugachia P.S. Case No. 50 of 2023, lodged on 04.03.2023 under Section 392 of the Indian Penal Code.

3. As per the prosecution case, the FIR has been lodged against unknown accused persons against whom there is an allegation that they have committed robbery from the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the name of the petitioner has been inserted in this case only due to the reason that his criminal antecedent is not clean as there are total 17 criminal cases pending against him in which in some cases, he is on bail and in some cases, he

Patna High Court CR. MISC. No.49195 of 2024(2) dt.24-07-2024 2/2 is not on bail. Counsel further submits that the petitioner is in custody since 13.04.2023 in the present case. Counsel also submits that other co-accused persons have been granted bail by this Court as well as by the Co-ordinate Bench of this Court.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that the petitioner appears to be a habitual offender as there are 17 criminal cases pending against him and this aspect must be taken into consideration.

6. In the present facts and circumstances, this Court is not inclined to grant regular bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner in connection with Sessions Trial No.741 of 2023 arising out of Naugachia P.S. Case No. 50 of 2023, pending before the learned Additional District and Sessions Judge-1, Naugachia, Bhagalpur is hereby rejected.

8. Liberty is hereby granted to the petitioner that he may renew his prayer for bail six months after framing of charge.
