The petitioner seeks bail in Sadar P.S. Case No. 426 of 2020, registered for the offence under Sections 420, 467, 468, 471, 34 of the Indian Penal Code and Section 20 / 22 of the N.D.P.S. Act..
As per the prosecution case, 200 gm of Charas, ATM Cards, ATM scanner machine, Rs. 25,000/- cash and one mobile phone have been recovered from the possession of the petitioner.
It is submitted on behalf of petitioner that the recovered Charas is less than commercial quantity. It is further submitted that charge has already been framed on 04.08.2021 and petitioner is in custody since 04.08.2020. Other similarly
Patna High Court CR. MISC. No.56802 of 2021(2) dt.10-12-2021 2/2 situated co-accused persons, from whose possession Charas was recovered, have already been granted bail.
Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-I, Muzaffarpur in connection with Sadar P.S. Case No. 426 of 2020.
