The petitioner, namely, Bhola Mistri is in custody since 03.08.2014 in connection with Khagaria P.S. Case No.484 of 2014 corresponding to G.R. No. 1683 of 2014 under Sections 457 and 380 of the Indian Penal Code.

Learned counsel for the petitioner submitted that the allegation is against the unknown persons. The police arrested one co-accused person, namely, Md. Nasimuddin, who confessed before the police and thereafter the petitioner has also been arrested on suspicion only. The police have also seized Rs.733/- which belongs to the petitioner.

Considering the nature of allegation and the period of

No.48556 of 2014 (2) dt.20-02-2015 detention, I direct that the petitioner named above be released on bail on furnishing bail bond of Rs.5,000/-(five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S.
