Heard Mr. Yogesh Chandra Verma, the learned senior counsel for the petitioner as well as the learned counsel for the informant.
The petitioner apprehends his arrest in connection with Goreakothi P.S. Case No. 82/2020 registered for offence punishable under sections 363, 366A/34 of the Indian Penal Code.
The informant Pappu Kumar Sah lodged FIR with allegation that his younger sister went in the morning of occurrence to ease herself, but did not return. Later on, he came
Patna High Court CR. MISC. No.56567 of 2021(2) dt.04-07-2022 2/3 to know that she was seen with co-accused Dhanu Kumar. The informant went to the house of Dhanu Kumar. The family members of Dhanu Kumar misbehaved him and they also stated that they would solemnize marriage of the victim with said Dhanu Kumar.
The learned counsel for the petitioner has submitted that there is no allegation in the FIR that the petitioner had kidnapped the victim. There is allegation against co-accused Dhanu Kumar, who has been granted bail. The victim did not mention the name of the present petitioner in her statement recorded under Section 164 of the Code of Criminal Procedure. The petitioner is a person of clean antecedent. Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-X, Siwan in connection with Goreakothi P.S. Case No. 82/2020, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove,
