JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 03-03-2015 Criminal Miscellaneous No.48059 of 2014 wherein Ravi @ Ravi Ranjan Singh @ Ravi Ranjan is the petitioner while Criminal Miscellaneous No.48388 of 2014 wherein Ram Manohar Pandey @ Ram Mahnohar Pandey is the petitioner commonly originate out of Bikram P.S. Case No.40 of 2014, Special Case No.13 of 2014 and on account thereof, have been heard analogously and are being disposed of by a common order. During conduction of raid both the petitioners along with Barun Kumar were apprehended while remaining managed to
Patna High Court Cr.Misc. No.48059 of 2014 (2) dt.03-03-2015 escape. Furthermore, from possession of Barun Kumar seven packets of smack, from the possession of petitioner Ravi @ Ravi Ranjan Singh @ Ravi Ranjan ten packets of smack and from the possession of Ram Manohar Pandey @ Ram Mahnohar Pandey ten packets of smack were seized. Furthermore, it has also been disclosed that each packet weigh 470 mg.
It has been submitted on behalf of petitioners that though the seized article happens to be less than 5 gm and on account thereof, comes under small quantity, however happens to be less than that as the weight so described includes the paper whereunder it was wrapped. Furthermore, co-accused Barun Kumar is found bailed out vide Cr. Misc. No.30291 of 2014. Accordingly, petitioners Ravi @ Ravi Ranjan Singh @ Ravi Ranjan, Ram Manohar Pandey @ Ram Mahnohar Pandey is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge, VII-cum-Special Judge, NDPS, Patna in connection with Bikram P.S. Case No.40 of 2014, Special Case No.13 of 2014.
