JUSTICE SANJAY PRIYA ORAL ORDER 3/ 06-11-2017 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the Informant. Petitioner apprehends his arrest in Harnaut P.S. Case No.140 of 2017 instituted for the offence under Section(s) 341, 323, 307, 354-A, 354-B, 504, 560/34 Indian Penal Code pending in the Court of the Additional Chief Judicial Magistrate, III, Nalanda at Biharsharif.

There is specific allegation against the petitioner of catching hold of daughter of the Informant and attempting to commit rape with her. He also tore her clothes. It is further alleged that he assaulted the daughter of the Informant, Alka Rani, with bricks causing injury in her ear.

Case diary has been received, wherein, Injury

Patna High Court Cr.Misc. No.41262 of 2017 (3) dt.06-11-2017 2/2 Report has been mentioned in para 19. The doctor has found injury on the person of Alka Rani caused by hard and blunt object and nature of injury has been kept reserved. In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.

Prayer of the petitioner for grant of anticipatory bail is rejected.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law on its own merit without being prejudiced by this order.
