JUSTICE ARVIND SRIVASTAVA ORAL ORDER 07-09-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Simri (Darbhanga) P.S. Case No. 68 of 2016 registered for the offence punishable under sections 328, 302, 201/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner is not named in the first information report and he has been implicated in this case on confessional statement of the coaccused. Except confessional statement, there is nothing against this petitioner. During investigation also, nothing has come to suggest complicity of this petitioner in the alleged crime. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the

No.35966 of 2017(3) dt.07-09-2017 2/2 petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Simri (Darbhanga) P.S. Case No. 68 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
